We thought you might like to read about an interesting discussion we are currently having with Her Majesties Customs and Excise in the UK. They have decided that most of James Jarvis’ characters are human and therefore fall into a customs category that attracts a rate of duty taxes. We are arguing that they are definitely not human and therefore fall into a category that does not attract duty taxes. The whole thing is quite surreal really. Here is an extract from the last letter we wrote to them. It’s long but it’s worth the read as it is quite ridiculous. A BTI is a statement produced by UK customs and Excise that declares the customs category code and gives information on the goods in question.The BTI states that the goods in question should have a Tariff code of 9502101090 DOLLS REPRESENTING ONLY HUMAN BEINGS: of plastics. We believe that our figures display characteristics of human beings but are most definitely not human beings. These figures are 3D representations of 2D illustrations drawn by an artist whose body of work comprises of a potato headed universe in which these characters reside. All characters have potato heads with the only facial features being eyes and a mouth (no ears and no nose). They all have impossibly short legs and only 4 digits on each hand. They all have goggle eyes with no eyebrows. These characters are creations from the mind of the artist and these creatures do not inhabit our world. In our application we tried to emphasise this point by including a statement by the artist, and evidence of some media interviews and statements he has given over the last few years in which he clearly states that these characters are not human beings. Part of the wording of the subheading for 9502101090 is:DOLLS REPRESENTING ONLY HUMAN BEINGS. Our characters are definitely not human beings so we believe they should be excluded from this category and heading.Further more, on the BTI, the Description of the goods states:Plastic toy figures of human caricature. Each has the physical characteristics of humans of standing upright on two legs, two arms, head with two eyes and mouth. Presented in Cardboard Box For Retail Sale.The description would seem to imply that the figures are a human caricature because they stand upright on two legs, have two arms and a head with two eyes and a mouth. These features are also evident in our characters King Ken, Wolfo, Ken Jnr and Desmond. These are similar to an ape, a wolf, another ape and another indescribable (clearly not human) creature. We also make a Hotdog Man and Kebab Twins that have these features yet are obviously not human (please see the attached papers for pictures of these characters). So it would seem that these features are therefore not exclusive to human caricatures but are simply human characteristics that can be applied to other creatures. The BTI description fails to mention ears and noses, which I would say are present on most humans and could be considered human characteristics. Yet they are not present on our characters. I am trying to highlight the premise that it is not enough to have human characteristics to be classed as ONLY HUMAN BEINGS.As I have stated, the figures we make are all creatures from other universes. They do not inhabit our world. Although they exhibit human characteristics they are definitely not human. For this reason we believe that the most appropriate tariff classification is 9503493000 TOYS RERESENTING ANIMALS OR NON-HUMAN CREATURES.”
